Hernia Mesh Settlement and Verdict Updates
As of November 2025, Becton Dickinson had reached an agreement to resolve much of the hernia mesh litigation involving the company. Hernia mesh lawsuits consolidated in multidistrict litigation, or MDL, against manufacturers Covidien, Atrium, C.R. Bard and Ethicon remain active, though there are not many pending cases remaining in the Atrium and Ethicon MDLs.
Ethicon and Atrium have been settling cases quietly without making the amounts public, but thousands of lawsuits are still pending for plaintiffs whose hernia mesh failed.
Most lawyers don’t give settlement predictions or average settlement amounts in active litigation because trying to gauge these amounts relies on too many factors and there are no guarantees. Any predictions could be misleading to plaintiffs.
Lawyers on both sides typically wait to see what happens during a bellwether — or test — trial to get an idea of potential global settlement values. However, some factors that go into determining settlement amounts may include the severity of injuries, the economic impact of injuries and future medical losses and damages.
Settlement and verdict updates in hernia mesh lawsuits:
October 2024:
Becton Dickinson announced that it has reached an agreement to resolve the “vast majority” of hernia mesh litigation involving the company. This should resolve tens of thousands of cases pending both in the MDL and in Rhode Island court.
April 2024:
The parties involved had not reached a decision in the potential Bard global settlement.
February 2024:
Judge Edmund Sargus, Jr. vacated the trial scheduling order for what would have been the fourth MDL bellwether trial against C.R. Bard held in April 2024, Bryan v. C.R. Bard Inc., et al. Judge Sargus directed the parties to head to mediation for a potential global settlement.
November 2023:
An Ohio jury awarded $500,000 to Aaron Stinson in the third Bard bellwether trial.
August 2022:
A Rhode Island jury awarded a $4.8 million verdict against Becton Dickinson, a C.R. Bard subsidiary.
April 2022:
Antonio Milanesi won a $255,000 verdict against C.R. Bard in the second bellwether trial.
July 2021:
Atrium agreed to a confidential global settlement of some of its cases. Some sources reported an amount of $66 million.
September 2021:
Ethicon settled some cases confidentially.
June 2011:
Bard offered to settle 2,600 Kugel hernia patch lawsuits for $184 million.
How Long Does It Take for a Hernia Mesh Lawsuit To Settle?
It can take years for complex litigation such as a hernia mesh lawsuit to settle, according to mass torts and product liability attorney Trent B. Miracle. Hernia mesh lawsuits are considered complex litigation and require extensive preparation and medical evidence.
Because there are thousands of hernia mesh lawsuits in federal litigation, moving them all through court proceedings takes time.
“It may take about three to seven years for complex litigation [such as a hernia mesh lawsuit] to settle.”
After a case is filed it goes through discovery, where hernia mesh manufacturers and plaintiffs produce medical records and other evidence. This includes getting experts to testify and presenting evidence to the judge. Then, both sides must pick cases that will serve as bellwether cases for trial and select a jury.
The outcome of these typically helps determine when defendants will settle and give both sides an idea of case value. However, the COVID-19 pandemic delayed many of the hernia mesh bellwether trials, so progress had been slow.
While Becton Dickinson recently announced a settlement agreement and Ethicon and Atrium have quietly settled cases, Covidien litigation is continuing through the MDL process.

Who Qualifies for a Hernia Mesh Settlement?
You may qualify for a hernia mesh settlement if you were injured by hernia mesh and filed a lawsuit against Ethicon, C.R. Bard, Covidien, Atrium or another mesh maker. The most recently announced global settlements are for people who filed lawsuits against Ethicon and Atrium/Getinge Group.

“People who are eligible for filing a hernia mesh claim would be folks who have had complications after a hernia mesh surgery. For example, if you’ve had a revision surgery or if you’re scheduled for a revision surgery, you should contact a lawyer as soon as possible,” attorney Daniel Nigh, partner at Nigh Goldenberg Raso & Vaughn, told Drugwatch.
If you have not yet filed a lawsuit but have been injured by hernia mesh, you may still be able to file and qualify to be a part of these global settlements. But it’s important to speak to a hernia mesh lawyer right away to see if you qualify.
“...If you’ve had a revision surgery or if you’re scheduled for a revision surgery, you should contact a lawyer as soon as possible.”
Before you speak with a hernia mesh attorney, it’s important to gather as much evidence as possible regarding your injuries and their potential connection to your hernia repair. Use this checklist as a guide for the information you should collect.
Hernia Mesh Injury Checklist
Communication with Health Authorities: Any correspondence you had with organizations like the FDA about negative reactions related to the mesh.
Doctors' Opinions: Insights from your doctors linking the mesh to any pain or health issues you are experiencing.
Follow-Up Surgeries: Records of any additional surgeries you may have needed after the initial repair.
Hernia Mesh Information: Documents related to the manufacturer of the hernia mesh, including labels, hospital records and medical bills.
Imaging Tests: Results from X-rays or MRIs that may show problems, such as the mesh shifting out of position.
Personal Records: Your own notes about pain levels, photographs of the affected area or any other personal observations.
Post-Surgery Problems: Notes on any issues you faced after the surgery, such as the hernia coming back, any holes created, the mesh moving from its original place or infections.
Surgery Details: Information about your hernia repair surgery.
Witness Accounts: Testimonies from doctors or family members who can share what they observed regarding your symptoms.
If you can recover the defective hernia mesh, it can enhance your lawsuit’s chances, though it’s not necessary for filing a lawsuit. If you’ve not yet had revision surgery, you should ask your surgeon to preserve any mesh they remove and turn it over to your lawyer.
Gathering this information will help demonstrate a clear relationship between your hernia surgery and any injuries you experienced. This connection is crucial for strengthening your case if you choose to pursue legal action.
How are Hernia Mesh Settlement Amounts Determined?
Hernia mesh settlement amounts — like other injury claims — are determined by considering factors such as the seriousness of the injury, financial and emotional damages, whether a plaintiff is married and whether they have lost and will lose substantial income because of the injuries. It’s important to understand that no one is guaranteed a settlement or a specific settlement amount.
In some litigation, officials in charge of the settlement will use what is called a settlement matrix. This matrix guides those disbursing money from the global settlement account in assigning value to a claim.
Some plaintiffs may get more money depending on how many conditions on the matrix they have and how serious their injuries are. For example, if a person had to have several surgeries because of hernia mesh injuries, they may qualify for more money.
Payouts in medical device cases, such as hernia mesh settlements, will typically be made over several years. They are also not based on a single, equal amount. Settlement amounts vary depending on the severity of the plaintiff’s injury and other factors.
The settlement may involve a tier system or individualized confidential settlements. With a tier system, your settlement amount will depend on the severity of your injury. The more severe the injury, the higher the tier and the higher the payout. Lesser injuries fall into lower tiers with lower payouts.
However, the terms of Becton Dickinson’s $1.7 billion settlement are confidential. This typically results in the company negotiating individual amounts for each lawsuit or groups of lawsuits with similar injuries.
Expert Perspectives
Drugwatch Analysis (November 2025)
The current status of hernia mesh settlements remains complicated. So far, manufacturers have resolved about 38,000 lawsuits, with settlements estimated to exceed $1 billion. Most of these cases are connected to Becton Dickinson, the company that owns C.R. Bard. However, new cases continue to come in, keeping the legal process active.
Some settlements with various manufacturers, such as Atrium and Ethicon, have been settled quietly, while others are still waiting for resolutions or trials. Judges have established systems to manage settlement funds, which helps streamline payments to those who have been injured. Settlement amounts can vary significantly, typically ranging from $60,000 to $100,000, depending on the severity of the injuries and the strength of available evidence.
Although manufacturers started making some settlement payments in 2025, more complex claims will take longer to resolve completely. While the legal process is entering a later stage, it is still open to new hernia mesh lawsuits.

Legal Perspective
“Our hernia mesh clients are people who have had surgical repairs of a hernia. The mesh is [a] surgical material that’s implanted by the surgeon to improve the strength of typically the abdominal wall.
The types of injuries that we see following that are infections and fistulas and things like that. Not necessarily immediately following the surgery, but maybe weeks or months down the road. Anytime we see those types of injuries, almost, without exception, they require another surgical intervention to repair the problem that was caused by the original implant.
Now, these particular hernia mesh products that we’re pursuing, it’s not a mistake made by the surgeon. It’s not medical malpractice. It’s a defective mesh that was being manufactured and marketed by certain manufacturers that are causing this problem. Those are the entities that we are pursuing in these lawsuits.”

“There are a lot of different types of mesh, but essentially, mesh is almost all the same. It’s just used in a different part of the body.
So when I look at those reports, if I just wanted to see what types of issues come in with mesh across the board, pain is always one of the first. [It’s] difficult to remove.
And then you also have internal bleeding at times, autoimmune diseases, and a lot of infections, I think, potentially due to some of the bioplastics and materials that are being used in mesh.”
FAQs About Hernia Mesh Settlements and Verdicts
You may have questions about hernia mesh settlements and verdicts, including whether you qualify, the average settlement amount and whether your hernia mesh settlement is taxable.
The answers below are just for reference. Always ask your attorney any questions you may have about your specific case.
You may qualify for a hernia mesh settlement if you suffered serious hernia mesh complications such as infection, chronic pain or adhesion related to defective hernia mesh, especially if you had to have revision surgery to repair faulty or recalled mesh.
Lawyers estimate that the average payout for a hernia mesh lawsuit ranges from $65,000 to $80,000. The exact figure is determined by considering things like severity of injury along with financial and emotional damages. It’s important to understand that no one is guaranteed a settlement or a specific settlement amount.
Generally, hernia mesh settlements are not taxable. Under the tax code, settlements that compensate you for physical injury or illness are tax free. However, punitive damages awarded as a part of a jury claim may be taxable. Consult a tax professional before accepting any settlement.
A hernia mesh lawsuit typically takes between one and three years to resolve. Some complicated cases can take between five and 10 years, especially if an appeal is involved. Several factors influence the length of the process. This includes case complexity, any difficulty gathering evidence, scheduling conflicts, and disagreements over responsibility and compensation amounts.
Becton Dickinson (BD) settled most hernia mesh lawsuits against C.R. Bard in October 2024, with payments scheduled over several years. You can still file a lawsuit, but you should act quickly due to your state’s statute of limitations. It’s advisable to consult a lawyer and see if your case qualifies for the settlement or can proceed outside of it.
Hernia mesh lawsuit settlement amounts vary based on the severity of your injuries and their impact on your life. In MDL cases, there may be a system to evaluate claims, with some being worth more due to complications or wrongful death.
To file a hernia mesh lawsuit, you'll need to gather documents such as your surgical and medical records, the implant's ID or brand, surgical reports, imaging scans, pathology reports and related medical bills. Keep a detailed record of your symptoms and any complications. Your lawyer can help you obtain these documents.
